UACDL membership is conditional on agreeing to these terms, as is the purchase of any UACDL product or registration for a UACDL CLE.
These terms incorporate both the Listserv policies and UACDL’s Privacy Policy. You agree to all of these terms and policies by participating with UACDL.
You must be a currently licensed, practicing criminal defense attorney in Utah to be a UACDL member.
Limited memberships are available for law students who intend to practice criminal law, people who have graduated law school but have not received bar results (treated as law students), social workers, paralegals, and investigators so long as your work in any of these arenas is criminal defense oriented. If that’s you, then you are a “limited member,” and you agree that these conditions apply to you except those conditions that are, by their plain meaning, exclusively directed at lawyers.
Refunds
If you’d like a refund, please contact us. We may give a full or partial refund but reserve the right to deny any refund. We will not refund a purchase if you misrepresented your professional status to obtain a UACDL membership, product, or registration in violation of these terms. We will not refund a membership if you violated listserv policies and had your listserv access terminated. We will not refund any purchases if you have violated these terms in any other way. Moreover, we reserve the right to refuse membership to anyone.
Non-dissemination of materials
You agree that by having access to UACDL resources and listserv emails that you will not share these resources or emails with any non-UACDL member.
Your voice, face, and likeness on streamed and recorded materials
You agree by registering for a seminar or purchasing a UACDL product that your voice, face, and likeness, along with any messages you send or other identifying information associated with that registration or purchase may be recorded and used by UACDL for any purpose associated with UACDL’s mission.
Non-disparagement or misrepresentation
You agree not to disparage UACDL, misrepresent its work, or use its logo without permission. Do not use UACDL as a platform to disparage other members. Do not criticize the work of either public defenders or private attorneys through UACDL.
Damages
You agree that by using UACDL resources and benefiting from its goodwill that UACDL’s value goes beyond easily quantifiable damages. You agree to liquidated damages of $5,000 for each cause of action that may arise from violations of these terms unless the damages can be reasonable calculated at a higher amount.
Venue and choice of laws
Any disputes that arise based on a violation of these terms will be adjudicated in the Third District Court in Utah. The laws of the state of Utah will govern.
